At 6:15 PM Regular members Waine Whittier, Ed Lawless, Alan Williams, and Creston Gaither conducted a site visit on the Stake/Weeks property on Kimball Pond, depicted on tax map 3 as lot 11-K to consider the owners’ proposal to add a structure to house radon mitigation onto the existing house.

At 7:00 PM the Board’s regular meeting convened at the Town House with Waine, Ed, Creston, Alan, and regular member Tim Bickford present. Minutes of the June 28 meeting were read and accepted.

Waine noted that when on May 28 he, Ed, and Tim met with builder Jon Kent on the Shuster Trust property on Parker Pond (depicted on tax map 11 as lot 44) to consider Jon’s proposal to build an open deck with a roof as an entrance to the existing house there, the requisite Findings of Fact were made, consistent with the Board’s usual procedure. 

Creston and Tim turned in two recently issued permits.

With regard to the Stake/Weeks proposal mentioned above, the applicants’ site sketch and application letter were briefly reviewed. It was agreed that the stone drain must be relocated to accommodate the drip edge. Based on its site visit and the materials submitted, the Board then found that the proposal:

1. will maintain safe and healthful conditions;
2. will not result in water pollution, erosion, or sedimentation to surface waters;
3. will adequately provide for the disposal of all wastewater;
4. will not have an adverse impact on spawning grounds, fish, aquatic life, bird or other wildlife habitat;
5. will conserve shore cover and visual, as well as actual, points of access to inland waters;
6. will protect archaeological and historic resources as designated in the comprehensive plan;
7. will avoid problems associated with floodplain development and use; and
8. is in conformance with the provisions of Section 15, Land Use Standards.

The Board then voted 5 – 0 to authorize Creston to issue the usual permit by letter for the project.

Alan noted that Robert Ames has sold his Kimball Pond property though the Shoreland Zoning permit issued to him required the removal of his non-conforming structures upon such sale.

Creston will try to find minutes etc. pertinent to the Ames situation and will email them to the rest of the Board.

Lingering questions about the sufficiency of Vienna’s existing land use ordinances were discussed informally. The Board will likely work on these in the early Fall.

3. The selectmen discussed with a resident the address that has been assigned to them on the Klir Beck Road.  It is believed the correct number would be an even number..  Selectmen will discuss this with the E911 addressing officers. There was also a discussion on the Tree Growth Laws, etc.
4. The Addressing Officers, Roger and Laura Reville, have submitted their resignation. If anyone is interested in this position, please contact us.
5. The selectmen signed a pole permit for a property on the Allen Road.
6. The school budget vote will be held on August 3rd at the Vienna Community building. Vienna's share has remained unchanged for this vote.

1. A resident was questioning her assigned address number on Klir Beck Rd. since it was an “odd” number and the other odd numbers were on the opposite side of the road. The selectmen will ask the E- 911 addressing officers to review the situation. She also had questions about the Tree Growth program and was given a copy of the Tree Growth laws.
2. Read and accepted minutes from the previous meeting; reviewed and dispersed mail.
3. Selectmen signed a pole permit form for Central Maine Power and Fairpoint Communications. The location is the Stream Rd. at the Allen Rd. intersection.
4. Selectmen discussed the RSU#9 School Budget vote to be held on Thursday, August 3rd in the Community Room. Hours: 1:00pm to 7:00 pm.
5. Selectmen learned that Roger and Laura Reville have asked to be replaced as E-911 Addressing Officers. If you are interested in this position, please call a selectmen or come to a meeting.
6. Meeting Adjourned.

2. Received a letter from Kirk Mahoney, State Historic Preservation Officer, stating that the Klir Beck House has been officially removed from the National Register. 
3. Reviewed and signed Warrant #14— $28,484.51. 
4. The selectmen filled out and signed the Maine Department of Transportation Local Road Assistance paperwork. The town will receive $24,000 to $26,000 in 2017 which will go to the Paving Account (as voted at town meeting).
5. Chief Church reported that the bill for the rebuild of the pump on the fire engine was received and paid. The total for the bill is $13,647, which is about $3,000 less than the estimate. The truck was also inspected and pump tested—everything passed.
6. Chief Church will be getting bids for resealing the parking lot at the Community Building/Fire Station.
7. The Fire Department has applied for a grant from the (Stephen and Tabitha) King Foundation. If they receive the grant for replacement air bottles, that will enable them to get up to date on air tank certification.
8. The Fire Chief and selectmen discussed chimney cleaning and the need for insurance. Neither the chief nor selectmen have been able to find an insurance policy to cover the firefighters (and the town) in this situation; therefore, they will be unable to clean chimneys for townspeople as firefighters with town equipment. Residents are encouraged to have their chimneys cleaned by professionals, or if possible, do it themselves.
9. Selectmen signed the Bank Reconciliation report.

2. Read and accepted minutes from previous meeting. The selectmen completed (for now) abatements for the 2017 season.

3. Selectmen discussed the Winter Sand Bid. Chris will contact the list of interested contractors. Selectmen will accept bids until September 12, when they will be opened at our regular meeting.

4. A letter was received from the Main Historic Preservation Commission stating that the Klir Beck House has been submitted for removal from the National Register of Historical Sites. Sadly the majority of the house was destroyed by fire some years ago.

5. The selectmen accepted Donnie Oliver’s bid of $1550.00 to mow the town roadsides and the old town dump.

3. Selectmen worked on tax abatements. 

• At 6:15 PM Regular members Waine Whittier, Ed Lawless, Tim Bickford, and Creston Gaither conducted a site visit on the Shawkey property on Kimball Pond, depicted on tax map 3 as lot 26-K to consider the Shawkeys’ proposal to build a house on the property. Very gentle slopes and ample setbacks were noted. Regular Board member Alan Williams, who is acting as the Shawkeys’ agent and contractor, was present for this discussion. No formal Board action was taken a this time.
• At 6:45 PM the Board’s regular meeting convened at the Town House with Waine, Ed, Tim, Creston, and Alan present. Minutes of the May 24 meeting were read and accepted. Tim confirmed that he has been duly appointed and sworn in as a regular member of the Board.
• It was noted that on May 28 Waine, Ed, and Tim met with builder Jon Kent on the Shuster Trust property on Parker Pond (depicted on tax map 11 as lot 44)to consider Jon’s proposal to build an open deck with a roof as an entrance to the existing house there. As Creston and Alan are both familiar with the parcel they subsequently agreed with Waine and Ed that this permit should be issued.
•  Cheryl Collier appeared for a Notification of Construction permit for a shed on her Davis Road property shown on tax map 6 as lot 6. Waine issued her a permit.
• Wendy Morin and Gary Fuller arrived about 7:00 PM. Wendy asked about tree removal on her Kimball Pond Road property, depicted on tax map 3 as lot 19. The Shoreland Zoning Ordinance was briefly reviewed. She was advised that no permit is required for the removal of dead trees. She outlined the nature of the natural growth and that of what she has planted. She brought a sketch and photographs. C.M.P. Co. has removed some treetops as well. Gary Fuller was asked to take a look at the photos as he is Vienna’s new Code Enforcement Officer (CEO). He said the growth looks dense and that much revegetation will naturally occur. 
• Gary introduced himself and asked about Vienna’s Land Use ordinances. The CEO’s relationship with the Planning Board was informally discussed. Waine will mail him CEO copies of Notification of Construction permits that are issued. Creston will email him the Board’s minutes and any reminders of meetings etc. that go out.

Susan Weeks’ email of June 28 was reviewed. Creston will respond to her and will advise her:

1. to find a local person to act as her agent and to advise the Board as to who this is.
2. to provide a sketch of her proposal with dimensions shown.
3. that the Board will want to do a site visit and will plan to do so at about 6:15 PM before its next meeting.

• The Shawkeys’ proposal to build a house on their Kimball Pond parcel (as referenced above) was considered. Alan is their contractor and agent and the Board has received an email authorizing him to act in this capacity. He thus recused himself from the Board’s formal deliberations in this matter. It was agreed that a silt fence and best practices will be required and that scarified soil must be seeded and mulched. No plumbing permit has been issued yet. Creston will check the flood maps and Alan will provide a sketch.
• Based on Alan’s verbal representations, and on its site visit, and assuming a favorable flood map review, the Board determined that, upon receipt of a sketch and plumbing permit, the project as outlined above:

1. Will maintain safe and healthful conditions;
2. Will not result in water pollution, erosion, or sedimentation to surface waters;
3. Will adequately provide for the disposal of all wastewater;
4. Will not have an adverse impact on spawning grounds, fish, aquatic life, bird or other wildlife habitat;
5. Will conserve shore cover and visual, as well as actual, points of access to inland waters;
6. Will protect archaeological and historic resources as designated in the comprehensive plan;
7. Will avoid problems associated with floodplain development and use; and
8. Is in conformance with the provisions of Section 15, Land Use Standards.

The Board then voted 4 – 0 to authorize Creston to issue the usual permit by letter for the project. The meeting adjourned at 7:40 PM.

3. Selectmen completed forms to request a mobile speed enforcement trailer in the Village. The trailer would inform drivers of the speed they were traveling as they drove past. There is no indication when we might receive such a unit– supply and demand.

2. The selectmen appointed Gary Fuller (441-5302) as the new Code Enforcement Officer. Mr. Fuller will continue to be our alternate plumbing inspector as well.
3. The selectmen worked on several tax bill corrections (abatements) along with a supplemental tax bill. There are always a few adjustments after the tax bills go out pertaining to changes for that year.
