5. Discussed the annual chimney cleaning with the Fire Chief. It has been determined that the Town is not covered by insurance for this work. MMA and Kyes Insurance,MEMIC, etc. have all told us that this kind of coverage is not available. Though the chimney cleaning is seen as a valuable prevention service, it is a liability to the town (and the Fire Chief).
6. Discussed the rebuild of pump on Fire Truck Engine 82; the estimate is $14,711.00. This quote came in from Reliance Equipment. The truck needs to pump 1250 gallons per minute and a leak in the seal box is causing the oil to froth up and could cause potential damage to the gear housing. The plan is to replace the seals and reuse the gears. The selectmen and Chief have decided the money will come from the Fire Department capital reserve account ($6118.01) and the fire department operating account
7. The Bank reconciliation report was reviewed and signed by the selectmen.
8. Maine Municipal Association Workers Compensation sent a $76.00 refund to the town. This is for not having any workers comp claims for the year.
9. Selectmen voted unanimously to adopt the General Assistance Ordinance Appendices A-E for 2016-2017.

MINUTES OF THE REGULAR MEETING OF THE VIENNA PLANNING BOARD HELD AUGUST 24, 2016

The meeting convened at 7:00 PM at the Town House on Town House Road. Regular Board members present were Waine Whittier, Alan Williams, and Creston Gaither. Also present were Heath and Laura Dolloff.

Town Clerk Annie Tibetts was present briefly and swore in Waine, Alan, and Creston for new 3-year terms.

The Board reviewed the permitting history of the Dolloffs’ Flying Pond lot (tax map 11 lot 13-H). Prior owner Austin Smith had built a structure under his 2007 permit but a microburst destroyed it. It had been on concrete blocks. The Dolloffs would like to build on the lot in the Spring and they presented a Building Ordinance application which they have submitted to Code Enforcement Officer John Archard; it includes evidence that wastewater permit # 2016 – 13 is in effect for the parcel.

The Board will visit the site at 6:30 PM prior to its September 28 meeting.

3. It was reported that the Egypt Pond Road sign has been stolen. Dodi will order a new one from White Sign. The cost will come out of Administration
4. Discussed an issue with the culvert on the Trask Road. The bottom of the culvert has rusted out and will need to be replaced at some point. Road Commissioner Goucher is monitoring the situation.

8. Selectmen worked on a Policy draft for Salary Draw for yearly salaried employees, i.e., Selectmen, Treasurer, Town Clerk, Tax Collector, Animal Control Officer, Web Master, Newsletter Editor, Fire Chief, Deputy Chief, and Assistant Chief.
9. At the next meeting the selectmen will review and vote on adopting the 2016-2017 General Assistance appendices.

3. Received a check from Maine Municipal Association for the fire department Safety Grant. ($2,000 plus)
4. Selectmen received a letter from the state department of bureau of motor vehicles stating that the recent audit of the Vienna Town Clerk was acceptable by the Bureau of Motor Vehicles standards

6. 2016 Salt prices are being held at the same price as 2016.  
7. Report from Dan Goucher, Road Commissioner: Portion of Bean Road has been paved, ditched and 3 new culverts have been installed. All driveways have been shimmed back to the road.
8. Made the annual Fire Truck payment of $14,141.00 to the United States Department of Agriculture. The Town has 6 payments left; the fire truck will be paid off in 2022.
9. Selectmen worked on the Auditors request list.
10. Selectmen discussed writing a policy stating if a selectmen or other employee fails to finish his/her term then the employee will be required to repay any salary they may have received beyond the amount of time worked for that year.

MINUTES OF THE REGULAR MEETING OF THE VIENNA PLANNING BOARD HELD JULY 27, 2016

The meeting convened at 7:00 PM at the Town House on Town House Road.

Regular Board members present were Waine Whittier, Alan Williams, Ed Lawless, and Creston Gaither. Also present were selectman Chris Smith, Code Enforcement Officer John Archard, and Ordinance Review Committee members Marianne Archard and Sue Burns. Creston had advertised this meeting as a public hearing to discuss disparities between setback requirements found in the Building, Shoreland Zoning, and Subdivision ordinances.

It was agreed that the Board’s finding that the Nathan James’ proposal for tax map 3 lot 40-K (see June minutes) provides for disposal of wastewater was likely erroneous. John Archard has visited the site and found only a straight pipe draining gray water, with a privy also in place. This is not permissible under State law. John and Mr. James and Ken Stratton are working toward a resolution.

The public hearing then came to order. Setback requirements were discussed at length. It was noted by several in attendance that measurements from the travelled way within a road are often more practical to make than measurements from right- of-way lines. The centerline of the travelled way is often more readily apparent than is its edge.

Uncertainty was expressed as to the optimum setback from roads with regard to aesthetics and safety and road maintenance and snowplowing.

Sue will try to find out what neighboring towns are doing in this regard. She also said that more data regarding the issues at hand should be gathered before changes are made to the ordinances.

Chris said that the selectmen are unwilling to call a special town meeting on this issue this year.

The Ordinance Review Committee will meet September 22; if they make good progress they will come to the Planning Board’s September meeting. If not they will come in October.

3. Health Officer Dr. Dan Onion notified the selectmen that the water test for the Flying Boat launch/swimming area passed. Dr. Onion stated that the water test showed less than 1/100cc for E-coli. A copy of the test was sent from the lab as well.
4. Selectmen received the results of the sales analysis done by Mike Rogers of the Maine revenue services. The combined sales ratio is 93%. This means our certified ratio will remain at 100% for 2017.
5. Selectmen completed a 2016 MMA Legislative Issues survey.

4. Discussed 30 Mile River Watershed and possible YCC projects with Sue Burns, Vienna’s representative. (Rock dams, fabrics, to help with erosion control, etc).
5. Discussed creating a road committee made up of 5 town residents, preferably from various parts of Vienna. Will put a notice in the August Newsletter.
6. Discussed Fire Department communication and possible Mutual Aid transmitter being placed on the new cell phone tower on Bessey Road.
7. Selectmen signed the letter of commitment with auditor Stephen Hopkins for the 2015 Audit.
8. Selectmen reviewed a letter of denial for abatement from John Sexton. A copy of the letter will be mailed to property owner.

3. On Wednesday, July 27, the Planning Board will hold a public hearing at 7:00 p.m at the Vienna Town House. The subject of the hearing is to discuss possible changes to the Building Ordinance, Shore Land Zoning and Subdivision Ordinance. This has been posted at the Selectmen’s Office, Post Office, Town Clerk’s Office and the Vienna web site.
4. Signed warrant for the RSU 9 budget revote. This will be held Thursday, July 28th from 1 PM to 7 PM at the Vienna Community Building.
5. Discussed building permits and possible permit denial with Code Enforcement Officer Archard.
