The Ordinance Review Committee met Thursday, December 15th at the Town House at 6:30 pm. 

Committee members discussed the draft amendments to the road setback requirements following the work session with the Planning Board in November.  The November meeting resulted in a compromise, proposing a setback of a consistent 50-foot distance from public roads and maintaining a 40-foot distance from private roads in the draft amendments to road setback requirements in the Building Ordinance, Shoreland Zoning Ordinance and Subdivision Regulations. The November meeting also discussed reducing the building permit fees for so-called hoop and shed-in-a-box structures.  Susan agreed to revise the draft amendments for the Committee's January 2017 meeting.

Committee members also discussed adding the term 'mobile home parks' to the list of uses/types of residences covered by the Subdivision Regulations. The proposed changes would include applicable definitions of terms and incorporate appropriate references to Maine State statutes regarding municipal regulation of mobile home parks.  Susan agreed to draft the proposed subdivision amendments for the January 2017 meeting.

[NO MEETING IN NOVEMBER OR LATE DECEMBER]

Creston had advertised this meeting as a substitute for the regularly scheduled November & December meetings which were cancelled in view of the holidays. The meeting convened at 7:00 PM at the Town House. Regular members present were Alan Williams, Ed Lawless, and Creston Gaither. Alan was elected Acting Chairman in Waine Whittier’s absence. Minutes of the October 26 meeting were read and accepted.

Dan Huettner wants to jack up the Ford cabin on Flying Pond and replace the existing foundation. Alan said it may not need a Shoreland Zoning Ordinance permit as it may be more than 250 feet from the pond. No change in its footprint is proposed. It was agreed that Mr. Huettner should contact CEO John Archard. Alan will do this on his behalf.

Creston will see whether he has a survey map depicting this cabin.

5. Selectmen had a discussion with Fire Chief Church on the Communication tower for the Lake Region Mutual aid. The radio communication is now narrow band. The communication system has been very unsatisfactory. Mutual Aid is looking to add two additional towers to the voter that will then operate four towers. Two are operational now, but there is a need to add two more to better the communication network. Each town will be asked to add $5,000 to the Tower system. There will be an article for this at March Town Meeting.
6. Discussed a parking issue with winter road maintenance. Some local residents are parking on the side of the road, which is causing an issue with proper snow removal and sanding after or during a storm. The hope is that residents will comply and park elsewhere when snow is expected. If this continues to be a problem, the town could instate parking bans which would be advertised on radio and television.
7. Selectmen signed and returned papers authorizing acceptance of the 2015 town audit draft.
8. Fire Chief Church reports that Mill Pond continues to fill up with mud-weeds. This could cause a problem with the pumps if the town has a fire as the Mill Pond has been a major source of water for the Fire Department. The Chief Church is looking for grants to help with cleaning out the pond.

The meeting focused largely on the draft ordinance revisions establishing consistent road setbacks in the Building, Shoreland Zoning and Subdivision ordinances. Much of the discussion pertained to the 60-foot setback from public roads and the purpose of the setback. Three of the PB members expressed concern that it was excessive, limiting building from too large an area of a lot. VORC members pointed out that on 4- rod (66 ' right-of-way) roads, a shorter 40- foot setback could result in buildings located only seven feet from the edge of the r-o-w. It was finally agreed to set the road setback distance at 50 feet, as currently required in the Subdivision Ordinance. It was also agreed to add proposed language addressing lots with both water and road frontage and setback requirements.

Discussion also covered considering the appropriate fees for building permits for temporary buildings as well as changes to the Subdivision Ordinance regarding mobile home parks.

Committee members agreed to invite the Planning Board to the November meeting to review and discuss proposed revisions to three ordinances: Building, Shoreland Zoning and Subdivision.

Discussion followed about developing draft language on consistent road setbacks in all three ordinances. The proposed changes would set a consistent 60-foot setback from public roads as currently required in the Building Ordinance and a 40-foot setback from private roads, establish measurement from the centerline of the existing traveled way and delete measurement from the edge of the r-o-w in the Building Ordinance.

Susan agreed to draft the proposed revisions and send them to other members in late October so the draft could be reviewed and revised before the November meeting with the Planning Board. The meeting adjourned at 8:05 pm

MINUTES OF THE REGULAR MEETING OF THE VIENNA PLANNING BOARD HELD SEPTEMBER 28, 2016

At 6:30 PM regular members Alan Williams, Ed Lawless, and Creston Gaither visited the Dolloff site on South Herrin Woods Road and Flying Pond, it being depicted on tax map 11 as lot 13- H. Very steep slopes were noted.

The regular meeting convened at 7:00 PM at the Town House. Alan was elected Acting Chairman in Waine Whittier’s absence.

The Board considered the Dolloffs’ proposal to build a house and a driveway on the aforesaid lot; their Building Ordinance permit application was also reviewed.

Based on its site inspection and the information provided by the applicants, and assuming a favorable subsequent review of the pertinent FEMA flood map, which Creston agreed to examine, the Board concluded that this project:

(1) Will maintain safe and healthful conditions;
(2) Will not result in water pollution, erosion, or sedimentation to surface waters;
(3) Will adequately provide for the disposal of all wastewater;
(4) Will not have an adverse impact on spawning grounds, fish, aquatic life, bird or other wildlife habitat;
(5) Will conserve shore cover and visual, as well as actual, points of access to inland waters;
(6) Will protect archaeological and historic resources as designated in the comprehensive plan;
(7) Will avoid problems associated with floodplain development and use; and
(8) Is in conformance with the provisions of Section 15, Land Use Standards.

The Board then voted 3 – 0 to authorize Creston to issue the usual permit letter for this proposal, subject to these CONDITIONS:

1). Erosion control measures such as a properly installed silt fence or erosion control mulch shall be employed in a workmanlike manner and in accordance with best management practices.
2). A stone apron must be placed beneath the new drip edges to control roof runoff.
3). Extra care shall be taken in constructing a driveway in order to prevent erosion.
4). The applicants will obtain the necessary Building Permit from Code Enforcement Officer John Archard.

3. Signed an abatement and a Supplemental tax bill. This is to correct a situation where land was sold to a family member, and some of the buildings were not put on the new lot.
4. The Mineral Spring Road sign has been stolen and a new sign has been ordered. The property owners have requested a “private way” sign as well; they will reimburse the town for the private way sign.
