MINUTES OF THE REGULAR MEETING OF THE VIENNA PLANNING BOARD HELD JUNE 25, 2014
The meeting convened at 7:00 PM at the Town House; regular members present were Waine Whittier, Ed Lawless, Austin Harrell, and Creston Gaither. Minutes of the May 28 meeting were read and accepted.
Waine has discussed the difference between "de novo" & "appellate" reviews (see May 28 minutes) with attorney Richard Flewelling at MMA and provided copies of a letter from Mr. Flewelling suggesting that the Board of Appeals be limited to appellate reviews. It was agreed that the "cell tower Ordinance" should be revised to provide for this. Mr. Flewelling also recommended against having the Ordinance allow for "intervenor status" (see May 28 minutes) because to allow this would be inconsistent with Vienna's general approach to this type of regulation.
Waine will work on a proposed draft for the revisions to the Ordinance. He may draft separate articles for different revisions so they could be voted on separately.
The Board briefly reviewed e-mails dated June 25 from Wendy Rackliff regarding her proposal to place fill on her Day Road property known as tax map 3 lot 32-K. Field notes from the Board's Sept. 17 site visit to this parcel were briefly reviewed. Shoreland Zoning Ordinance Sect. 15. G, was reviewed. Concerns were raised regarding both the proposed size of the parking area and runoff control and whether the extent of proposed fill is to exceed 10 CY.
Creston will relay these concerns to Mrs. Rackliff and seek additional information.
