MINUTES OF THE REGULAR MEETING OF THE VIENNA PLANNING BOARD HELD JANUARY 27, 2010
The meeting convened at 7:00 PM at the Town House. Members present were Waine Whittier, Alan Williams, Nanou Laliberte, and Creston Gaither. Minutes of the December 23 meeting were read and accepted.
Howard Charles' forest management plan for the Potter parcel on Tower Road (tax map 5 lot 14) was reviewed along with the Resource Protection and Timber Harvesting Ordinance (RP/THO). Erosion control and regeneration plans required by the Ordinance were not explicitly labeled as such. It was agreed that, by stipulating "best management practices" and "selective harvesting," the management plan meets, respectively, the erosion control and the regeneration plan requirements. It was agreed that the permit should state these assumptions. The board then voted to authorize Creston to issue a RP/THO permit for this harvest.
Jon Hambrick's application for renewal of his Sept. 24, 2008 Shoreland Zoning Ordinance (SZO) permit was reviewed. The board then made findings of fact as per Sect. 16.D. of the SZO, found the proposal conforming (provided that the same conditions outlined in the 2008 permit are met), and authorized Creston to issue the usual SZO permit by letter, subject to said conditions.
Repeal of the RP/THO was discussed. Creston and Alan's e-mail exchanges with District Forester Morten Moesswilde were reviewed. In general Mr. Moesswilde recommends repeal, due to the Ordinance's redundancy (given current State requirements), the out-datedness of some of its provisions, and some enforcement concerns. The board voted unanimously to authorize Waine to draft a repeal article for Town Meeting.
Creston will reorder the 2010 Land Use Pamphlets, having received no response to the board's earlier inquiries.
Waine expects to miss the board's February meeting.
