The meeting convened at the Town House at 7:00 PM; members present were Waine Whittier, Alan Williams, Creston Gaither, and Tim Bickford. Also present were Bruce and Pam Feathers and Mark Rains.

The Featherses were issued a Notification of Construction permit for a storage shed and an existing canopy shed; the property is shown on tax map 5 as lot 19.

Minutes of the Sept. 27 meeting were read and accepted.

Mark asked about Town requirements for a bed and breakfast. It was noted that only a small portion of  Mark’s house lies within the Shoreland Zone. The Shoreland Zoning Ordinance (SZO) was briefly reviewed in this regard. The Board advised Mark that nothing in the SZO would appear to preclude the operation of a bed and breakfast, and that State Plumbing Code requirements would be the most important limitation, especially as additional bedrooms would be involved. The definition of “home occupations” in the SZO was briefly reviewed. It was not clear whether it would apply to a bed and breakfast. It was suggested that the safest option would be for Mark to obtain a SZO permit. He did not make  formal application and the Board thus took no formal action in this matter.

Recent correspondence was reviewed.

Waine reported that the Ordinance Review Committee met last week and decided to suspend the committee until a pertinent issue requires it to convene. They would like to have a 5-member committee and would like to have a Planning Board member involved. The Board agreed to discuss this at a future meeting. Waine advised them of some changes to the SZO the Board may recommend for adoption at the March town meeting.

The November and December Board meeting dates were discussed. All present said they could attend the November meeting at its usual date. The Board’s suggested ordinance changes should be considered at that meeting.

3. The selectmen met with Charlie Baeder, representative of Belgrade Regional Conservation about the Kennebec Highlands. They are looking into acquiring a Vienna property. There was a general discussion on the management plan of the Kennebec Highlands. Selectmen discussed the tax exemptions along with tree growth and that the state owned land is exempt from taxes. The discussion went into the abandonment of roads on the Kennebec Highland property. The roads were closed around 1992 to town maintenance but were left open to public access. It was noted that some of the road has been blocked and the selectmen requested that the road be re-opened. The selectmen will be having more meetings with the state before the management plan is updated. The Kennebec Highlands are looking to purchase more property within Vienna.
4. Dodi reported that she attended the Ordinance Review Committee meeting on the 19th. Also present were Sue Burns, Jim Anderberg, and Waine Whittier. It was agreed that the committee going forward will have five members including one from the Planning Board. The selectmen are looking to appoint two new members. It was also agreed that there would be no more meetings until a need is determined.

The Ordinance Review Committee (VORC) met Thursday, October 19th at the Town House at 6:30 pm. Present were Jim Anderberg and Susan Burns, VORC; Dodi Thompson, 1st Selectman; Waine Whittier, Planning Board Chairman

The first discussion item was the VOR Committee makeup, size and tasks. Those present agreed to the expansion of the Committee from three members (one seat is currently vacant) to five and the inclusion of a Planning Board member as one of the three new appointees. The Selectmen will appoint the new members. Meetings  of the Committee will resume after the appointments have been made and a need for ordinance work has been determined.

The second discussion item pertained to Planning Board ordinance work. Waine indicated the Planning Board is considering proposed amendments to Vienna's Shoreland Zoning Ordinance in line with the Maine State Shoreline Zoning Guidelines.

The last item involved a general discussion of the referendum and laws pertaining to marijuana. The State has yet to address the law, which may occur either later this year or in 2018.

Susan Burns

3. Warrant #18 was reviewed and signed ($107,568.43)
4. The Cumner Road has been paved and work has started on the Davis Road hill. The Road Commissioner has started the removal of the base of the road to replace with a better packing product. The road has always been a clay and rock base. The new base will be crushed stone that will be much better and more stable. This should help maintain the new pavement that will be applied later this month.
5. The selectmen reviewed the Bank Reconciliation Report.
6.  The selectmen worked with a resident in reference to a foreclosure on his property.
7. The Cemetery Sexton sold four lots this week. Copies were made of the deeds.

3. Discussed the need to improve the road in the Municipal Cemetery across from the church on Tower Road.  
4. The town received the state’s estimated assessment of the town for 2018... $68,600,000.  
5. The selectmen discussed the guidelines for Bulky Pickup day. The collectors will not pick up building material or tires on rims. Complete guidelines can be found on the back of the Waste/ Recycle Schedule that is inserted in the Town Report. Additional copies are available at the Town House.

3. The Vienna Fire Department received a grant for $7,000 from the Stephen and Tabitha King Foundation. This money will be used to replace the outdated air pack bottles for the SCBAs.
4. Reviewed and signed warrant #19 ($20,260.16)
5. The selectmen signed the warrant and notice of election for the RSU #9 Budget Referendum. This will be held on October 24th at the Community Center.
6. Discussed with a town resident the need to do ditching in front of his property to help prevent the washing out of the town road. The Selectmen will visit the location and come up with a plan; there was further discussion on the road crown and ditching of the road.
7. The selectmen reviewed and signed the bank reconciliation report.
8. The selectmen voted to except the recommended appendices for the 2017- 2018 General Assistance Ordinance.
9. There is an Ordinance Review Committee meeting scheduled for Thursday, October 19th, 6:30pm at the Town House.

At 6:15 PM Regular members Ed Lawless, Alan Williams and Creston Gaither met with
contractor Jim Meader on the Thomas and Dorothy Moore site on Flying Pond, depicted on tax
map 10 as lot 42; the owners would like Jim to install a foundation beneath the existing camp,
which is currently on posts. The camp is currently about 50 feet from the pond. Some trees to
the west and east of the camp would have to come down to allow equipment and to move the
camp during construction. The rules regarding expansion of non-conforming structures in the
Shoreland Zone were informally reviewed and discussed. The Board advised Jim that going up
on the structure, as the owners would also like to do, would not be allowable. No plumbing is
involved. Jim has written authorization to act as the owners’ agent.

At 7:00 PM the Board’s regular meeting convened at the Town House with the aforesaid
members present, along with Jim Meader. Minutes of the August 23 meeting were read and
corrected and accepted. Alan was elected Acting Chairman in Waine Whittier’s absence.

The Moores’ proposal, as outlined above, was discussed. It was agreed that the usual silt fence
and erosion control measures will be required. And that the earthwork is to be done by a
contractor certified for Shoreland Zone work. Any excavated material is to be removed from the
Shoreland Zone entirely. Jim will provide the written authorization from the owners to allow
him to act as their agent. Creston will check the flood hazard maps for this parcel.

Based on its site visit and Jim’s representations and a presumption that the flood maps will
indicate no flood management issue, the Board then found that the proposal:

1. will maintain safe and healthful conditions;
2. will not result in water pollution, erosion, or sedimentation to surface waters;
3. will adequately provide for the disposal of all wastewater;
4. will not have an adverse impact on spawning grounds, fish, aquatic life, bird or other wildlife habitat;
5. will conserve shore cover and visual, as well as actual, points of access to inland waters;
6. will protect archaeological and historic resources as designated in the comprehensive plan;
7. will avoid problems associated with floodplain development and use; and
8. is in conformance with the provisions of Section 15, Land Use Standards.

The Board then voted 3 – 0 to authorize Creston to issue the usual permit by letter for the project.

Copies of a proposed Moratorium Ordinance regarding Recreational Marijuana were distributed
and discussed informally. The Board took no position on the matter at this time.

Creston Gaither, secretary

3. The selectmen worked on the tree growth report.
4. Allan Trask spoke to selectmen about one of his properties on Cemetery Road.  He provided the selectmen with documentation of a transfer of a portion of that property to the Cemetery Association.  This will be included in the changes for 2018.
5. The selectmen will be voting on the 2017 - 2018 General Assistance Appendices at the next meeting, October 3rd.  This is an annual that allows the town to meet state recommendations.
6. The selectmen are looking for a new E911 addressing officer. The person would be responsible for assigning house numbers to the new homes and the upkeep of the records.  If you are interested in this position please contact one of the selectmen.

3. Reviewed and signed Warrant # 18 ($161,077.71).
4. The selectmen received four verbal bids for the winter sand. The lowest bid was from Dan Goucher for $4.45 a yard, which was accepted.  The other three bids came in at $4.50 per yard. Mileage and the cost per yard were considered.
5. The selectmen talked with road commissioner Danny Goucher: The Mountain Road will be getting repair. The week of the 30th the paving will begin on the Cumner Road and the Davis Road. The road side brush removal is going to be starting in the next couple of weeks - discussed the need for road side tree/branch trimming in preparation of the upcoming plow season; also discussed the need for snow plow turnarounds; it seems one of the turnarounds needs to be relocated.
6. The selectmen discussed the sign theft issue.  Over 12 signs have been stolen over the last couple of weeks.  This has been a problem all summer as many road signs have been stolen and it becomes quite expensive to replace them all. In order to cut the cost of signs the town has been replacing the stolen signs with wooden signs.
7. The winter sand will be put up the first week of November.
