MINUTES OF THE REGULAR MEETING OF THE VIENNA
PLANNING BOARD HELD AUGUST 22, 2012


At 6:00 PM Regular members Waine Whittier, Alan Williams, Nanou Laliberte, and Creston Gaither met with contractor Ryan Jones at the Hanson site on Flying Pond (tax map 11 lot 5-F) regarding the owners' proposal to jack up the existing structure and install a frost wall under it in its existing footprint. The structure is extremely close to the pond. The Board understands that the excavation is to be done from the side farthest from the pond and the material pulled back away from the pond. The usual conditions requiring a silt fence etc. will likely be necessary. There is no upstairs in the existing building; there is a half-loft on the southerly side of the structure. In considering the rules for expansion of non-conforming structures it was noted that with the existing shed there is most likely greater than 1000 sf of floor area in evidence. It was noted that the existing shed lies about 45 feet from the pond at its southeasterly corner. Creston will notify Code Enforcement Officer John Archard of this. From this site the Board went to the Rodney Ellis property on Town House Road, ( map 2 lots 13A & 13C) to consider his proposal to build a bridge over the stream which crosses the property and a second bridge more easterly from this location.

At 7:00 PM the Board, the aforesaid members being present, met at the Town House. Minutes of the July 25 meeting were read and accepted.

The Board then considered the aforesaid Hanson proposal. Section 12 C (1)(b) of the Shoreland Zoning Ordinance (SZO) was reviewed. It was agreed that the current proposal is not an expansion of the structure. The practicality of moving the structure to meet current setback requirements was thus deemed irrelevant. The Board then made findings of fact as per Section 16.D. of the SZO, and found this proposal conforming, and voted to authorize Creston to issue the usual permit by letter, subject to the usual conditions regarding erosion control.

The Board then considered Rodney Ellis' bridge proposal. It made findings of fact as per Section 16.D. of the SZO , and found this proposal conforming, and voted to authorize Creston to issue the usual permit by letter, subject to the usual conditions regarding erosion control and best practices.

William MacDonald appeared concerning his parcel on Day Road near Kimball Pond. he would like to construct a 20' x 24' storage building across the road from the existing camp. Because the Board is familiar with the site and the proposal is somewhat modest, the usual site visit was waived; the Board then made findings of fact as per Section 16.D. of the SZO , and found this proposal conforming, and voted to authorize Creston to issue the usual permit by letter, subject to the usual conditions regarding erosion control.; and requiring crushed stone to be placed under the drip edges.
