MINUTES OF THE REGULAR MEETING OF THE VIENNA PLANNING BOARD HELD APRIL 28, 2010
At 6:30 PM regular members Nanou Laliberte, Ed Lawless, and Creston Gaither met with contractor Ryan Jones at the Burke site on Flying Pond (tax map 11 lot 29-V; see below). The regular meeting convened at 7:00 PM at the Town House where the board was joined by regular member Alan Williams, who was elected Acting Chairman in Waine Whittier's absence; and by Mr. Jones and Gene and Sherry Schramm. Minutes of the March 24 meeting were read and accepted.
Mr. Jones presented documentation regarding the Burke's proposal to install a new foundation under their home at the aforesaid site and to install a retaining wall behind it. No new plumbing or change in use is proposed. The board made findings of fact as per Section 16.D. of the Shoreland Zoning Ordinance
(SZO), found the proposal conforming, and voted to authorize Creston to issue the usual permit by letter, subject to conditions regarding soil erosion, the minimization of tree removal, and the removal of any excess material to a site outside the shoreland zone.
The Schramms would like to renew their permit dated July 2, 2007 (for tax map 10 lot 40) so that they can build a garage and put stairs on their house. They would also like to replace their existing woodshed with a somewhat larger one (approximately 8' x 12'). It appears that the existing deck (in the former house site footprint) measures approximately 540 sf. Sect. 12.C.(1).(a).iii of the SZO was reviewed regarding the expansion of such non-conforming uses. It appears that the woodshed could be expanded by approximately 460 sf. The usual site visit was waived as the board has been to the site several times. The board made findings of fact as per Section 16.D. of the SZO, found the proposals conforming, and voted to authorize Creston to issue the usual permit by letter, subject to the conditions that the total combined area of the new woodshed and existing deck not exceed 1000 sf; that a silt fence be installed if any significant site work is performed; and that the existing setback be maintained.
Sue Burns is ill and thus unable to attend this meeting. She had forwarded the Mount Vernon Site Plan Review Ordinance, and Creston had e-mailed or provided copies to all members. She hopes to attend the May meeting.
Ridgely Fuller's e-mails regarding "Big Island" were discussed. The board agreed to wait until it has a specific proposal to decide whether a site visit is necessary.
Creston reported that the State has revised its GIS layers to show Lane's Brook as Vienna's southeasterly boundary (see December 2009 minutes).
Creston will advise Roger Wing to seek appointment by the selectmen (see March minutes).
